BlueAge Terms of Service

Welcome to BlueAge by Bluegrass Precision Wellness (“BlueAge,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the BlueAge hardware, software applications, website, backend services, APIs, and other related products and services (collectively, the “Services”). By using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.



1. Eligibility & Account


1.1 Eligibility. You must be at least the age of majority in your jurisdiction and have full power and authority to enter into these Terms.
1.2
Account Registration. To use certain features, you may be required to register for an account, provide accurate and complete information, and maintain and update it.
1.3
Credentials. You are responsible for safeguarding your login credentials and any activity under your account. You agree to notify us immediately of any unauthorized use.



2. Use of the Services


2.1 Permitted Use. You may use the Services for your personal, non-commercial use (unless expressly authorized).
2.2
Prohibited Conduct. You agree not to:

  • Reverse engineer, decompile, or attempt to derive source code from our software;
  • Use the Services in a way that violates applicable law;
  • Interfere with security or integrity of the Services;
  • Use robots, spiders, or automated scripts to access or query the Services;
  • Impersonate others or provide false information.

2.3 Modifications & Updates. We may modify, suspend, or discontinue portions of the Services at any time, with or without notice, and without liability to you.



3. Data Collection & Health/Wellness Disclaimers


3.1 Data Collection. In the course of delivering the Services, we may collect biometric, health, activity, sleep, sensor, environmental, and related data (collectively, “Health Data”).
3.2
No Medical Advice. The Services are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Health Data and insights are for informational/wellness purposes only. You should consult a medical professional before making changes to your health or fitness based on the Services.
3.3
No Liability for Health Outcomes. You assume all risk for any decisions or actions you take based on the Services.



4. Subscriptions, Fees & Payments


4.1 Fees & Billing. Some features may require subscription or membership fees. You authorize us to charge the applicable fees to your payment method.
4.2
Changes to Pricing. We may modify pricing or introduce new fees, upon notice.
4.3
Refund Policy. Except as required by law, fees paid are non-refundable.



5. Intellectual Property


5.1 Ownership. All content, software, data, designs, trademarks, and logos in the Services are owned by BlueAge or its licensors.
5.2
License to You. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services in accordance with these Terms.
5.3
Feedback. If you provide feedback or suggestions, you grant us a perpetual, worldwide, royalty-free license to use such feedback.



6. Third-Party Services & Integrations


You may choose to integrate or connect your BlueAge data with third-party services (e.g. Apple Health, Strava). Use of such integrations is subject to their terms and privacy policies, and you permit us to share requested data with them.



7. Termination & Suspension


7.1 Termination by You. You may terminate your account at any time.
7.2
Termination by Us. We may suspend or terminate your access for breach of these Terms, or for any reason, with notice or immediately.
7.3
Effect of Termination. Upon termination, your access to the Services ceases, but Sections regarding data use, disclaimers, and liability will survive.



8. Warranty & Disclaimers


8.1 Limited Warranty (Hardware). For hardware devices you purchase, we may provide a limited warranty covering defects in materials or workmanship for a defined period.
8.2
Disclaimer. Except to the extent prohibited by law, the Services and all content are provided “as is” and without warranties of any kind (express, implied, statutory).
8.3
Limitation of Liability. To the maximum extent permitted by law, BlueAge’s aggregate liability is limited to the amount you paid us (if any) in the past 12 months. We are not liable for indirect, incidental, punitive, or consequential damages.



9. Indemnification


You agree to defend, indemnify, and hold harmless BlueAge, its affiliates, officers, directors, employees, and contractors from any claims, liabilities, damages, losses, or costs (including reasonable attorneys’ fees) arising from (a) your use of the Services, (b) your violation of these Terms, or (c) your violation of third-party rights.



10. Changes to Terms


We may revise these Terms from time to time. We will notify you of material changes (e.g. via email or in-app). Continued use after changes implies acceptance.



11. Governing Law & Dispute Resolution


These Terms are governed by the laws of Kentucky, USA. Disputes may be resolved via binding arbitration or in courts in Kentucky. Subject to your choice and applicable law.



12. General


  • Severability. If a provision is invalid, the rest remain in effect.
  • Waiver. A failure to enforce a right is not a waiver.
  • Assignment. You may not assign your rights or obligations without our written consent.
  • Entire Agreement. These Terms, plus any additional policies (e.g. privacy), constitute the entire agreement between you and BlueAge.
